VANCOUVER (CKNW/AM980) -- BC's highest court has granted Canada Customs leave to appeal a legal funding ruling stemming from its latest obscenity battle with the Little Sister's Book and Art Emporium in Vancouver's West End.

The trial - over customs' seizure of adult comics the gay book store was trying to import into the country - is not set to be heard until next April.

In the meantime, the government agency will attempt to overturn a June court ruling ordering it to pay Little Sister's court costs in advance.

The BC Court of Appeal has granted leave on the issue, saying it raises important questions concerning the scope of an earlier funding ruling involving the Okanagan Indian Band and how it should be applied to other cases.

Four years ago, the West End book store scored a victory in the Supreme Court of Canada, when it ruled Canada Customs must prove the material it rejects is obscene by law.
